Russell County Courthouse, Lebanon, Virginia

 

Memorandum of an Agreement entered into this second day of June in the year of our Lord Eighteen hundred and eighteen between Jesse Callison and Mary his wife of the County of Washington and Commonwealth of Virginia of the one part, and Samuel Phelps of the county of Russell and Commonwealth aforesaid of the other part.  Witnesseth that the said Jesse Callison and Mary his wife for and in consideration of the sum of one hundred good and lawful money of the United States to them in hand paid by the said Samuel Felps before the signing sealing and delivering of these presents have granted bargained and sole and by these presents do grant bargain and sell unto the said Samuel Phelps a certain tract or parcel of land lying and being in the said county of Russell on the waters of Mockasson Creek on both sides of the Crane fork of said Creek containing 40 acres be the same more or less.  Beginning at a Mulberry Sugartree white Walnut Locust and ash on a hill side thence West 152 poles to a black walnut cucumber hickory and ash on a ridge S15W36 poles to a beach and cucumber near the head of a large Spring N50E33 poles to a cucumber on a hill side S76E47poles to a cucumber lynn and sugartree S44E35 poles to two buckeyes and a black walnut on a branch N40E81 poles to the beginning.  With its appurtenances to have and to hold to the said Samuel Phelps his heirs and assigns forever.  And the said Jesse Callison and Mary his wife for themselves their heirs or either of their heirs the said tract of land with and singular its appurtenances to the said Samuel Phelps his heirs and assigns forever.   And the said Jesse Callison and Mary his wife for themselves their heirs or either of their heirs do and will warrant and forever defend the right and title of said land free from the claim or claims of all and every other person or persons whomsoever.  In testimony whereof the said Jesse Callison and Mary his wife have hereunto set their names and affixed their seals the day and date first above written.

This Indenture of bargain and sale from Jesse Callison and Mary his wife to Samuel Phelps was acknowledged before me by the said Jesse to be his act and deed and admitted to record.
