Russell County Courthouse, Lebanon, Virginia

This indenture made this 2nd day of April in the year of Christ one thousand eight hundred and twenty two between Samuel Phelps and Susannah his wife of the County of Russell and State of Virginia of the one part, and John Phelps of the County and state aforesaid of the other part. Witnesseth, that the said Samuel Phelps and Susannah his wife for and in consideration of the sum of fifty Dollars lawful money of the United States to them in hand paid the receipt whereof is hereby acknowledged, hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John Phelps his heirs and assigns a certain tract or parcel of land lying and being in the said County of Russell on the North side of Clinch Mountain and waters of Mockerson Creek, containing twenty five acres, and bounded as followeth to wit:  Beginning on a marked growth in a line of said Samuel Phelps land known by the name of Callison’s tract and running round the East end of said tract with the lines of the same so as to include a certain building and improvement and also to include the above named twenty five acres of land with its appurtenances, to have and to hold the said tract or parcel of land with its appurtenances to the said John Phelps his heirs and assigns, to his and their proper use and behoof forever.  And the said Samuel Phelps and Susanna his wife doth hereby covenant and agree to and with the said John Phelps, the tract of land aforesaid to him the said John Phelps his heirs and assigns against the claim or claims of all and every other person whomsoever, he the said Samuel Phelps and Susannah his wife for themselves, their heirs or either of their heirs shall and will forever warrant and defend.  In witness whereof the said Samuel Phelps and Susannah his wife have hereunto subscribed their names and affixed their seals, the day and year first above written.

This indenture of bargain and sale was on the 2nd day of April 1822 acknowledged before me in the Clerk’s office of the Russell County by Samuel Phelps party thereto to be his act and deed, and admitted to record.

Notes:  The John Phelps mentioned here is assumed to be the son of Samuel Phelps and the father of Ida Frances Phelps.  If so, John Phelps was 22 years old when he bought this land.  However, I can’t rule out that this John Phelps is a brother to Samuel.  I found a deed in Washington County for a John Phelps dated 1809 that clearly couldn’t be “our” John Phelps.  There are still some threads to unravel.  Also, as you will see in a subsequent deed, the acreage on this parcel of land gets reevaluated down to twenty acres at the time John Phelps sells it to John Kestner in 1837.
