Russell County Courthouse, Lebanon, Virginia

This indenture made this 16th day of October 1832 between Samuel Phelps of the county of Russell and state of Virginia of the one part and Martin Phelps of the county of Washington and state aforesaid of the other part.  Witnesseth that the said Samuel Phelps for and in consideration of the natural love and affection which he has for the said Martin, and for the further consideration of the sum of one dollar paid to the said Samuel as the sealing of these presents doth bargain and sell unto the said Martin Phelps the following property to wit:  five head of cattle, eight head of sheep, one brown mare one still and fifteen dollars, twenty eight head of hogs and all the pasture [??] two beds and bedclothes one chest and all the clothing about the house two ploughs three hoes three augers one frow [??] nine shilling.  Eighty Dollars upon John Kestner, George Gobble fore and six Tolbert two and three pence one gun fifteen plate two dishes fore Basins three bales three glases one set of tea cups and sasers one Coffee pot nine chairs two wheels one clock one table fron dogs.  To have and to hold the said property to the sole use and behoof of him the said Martin Phelps against the claims of all persons whomsoever.  In witness whereof the said Samuel Phelps hath hereunto set his hand seal the day and year first written.

Russell County to wit.

 

We James Dickenson and William Gilmore justices of the peace in the county aforesaid in the state of Virginia do hereby certify that Samuel Phelps a party to a certain deed bearing date the 16th day of October 1832 and hereunto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgement to the Clerk of the County Court of Russell in order that the said deed may be recorded.  Given under our hands and seals this 16th day of October 1832.

This indenture of bargain and sale from Samuel Phelps to Martin Phelps certified to have been acknowledged before two Justices of the Peace was produced to be in the Clerk’s office of Russell County on the 15th day of November 1832 and admitted to record.

This Indenture made this 16 day of October 1832 between Samuel Phelps of the county of Russell and state of Virginia of the one part and Martin Phelps of the county of Washington and state aforesaid of the other part.  Witnesseth that the said Samuel Phelps for and in consideration of the natural love and affection which he has for the said Martin Phelps, and for the further consideration of one dollar to him in hand paid doth grant bargain and sell unto the said Martin Phelps a certain piece or parcel of land containing fifteen acres, more or less, lying in the county of Russell on the waters of big Mocquason, being the tract on which the said Samuel Phelps now lives, adjoining John Kestner, David Phelps and Joseph Chapman together with its appurtenances to have and to hold the same said piece or parcel of land with its appurtenances unto the said Martin Phelps to the sole use and behoof of him the said Martin Phelps and his heirs forever and the said Samuel Phelps for himself and his heirs doth covenant with the said Martin Phelps and his heirs, that he the said Samuel Phelps and his heirs the said piece or parcel of land with its appurtenances unto the said Martin Phelps against the claims of all persons whomsoever shall warrant and forever defend.

 

In witness whereof the said Samuel Phelps and wife hath hereunto set their hand and seal this day and year first written.

We James Dickenson and William Gilmore Justices of the Peace for the county aforesaid in the state of Virginia do hereby certify that Susan Phelps, the wife of Samuel Phelps parties to a certain deed bearing date the 16th October 1832 and hereunto annexed personally appeared before us in our county aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her she this said Susan Phelps acknowledged the same to be her act & deed and declared that she had willingly signed seald and delivered the same and that she wished not to retract it.  Given under our hands and seals this 16 day of October 1832.
