John Phelps buys 25 acres from David Campbell

This indenture made this twenty first day of September 1835 between David Campbell of the one part and John Phelps of the other part.  Witnesseth that the said David Campbell for and in consideration of five dollars many years ago in hand paid doth bargain and sell unto the said John Phelps a piece or parcel of land lying in little Mockinson gap containing by estimation twenty five acres lying on both sides of the Russell road between the lines of a fifty acre tract conveyed by Isaac Lynder to John Phelps, a forty acre tract now belonging to James Welch and conveyed by Henry and Boggs to Robert Combs and the patent line of Henry and Boggs large survey with all its appurtenances To Have and to Hold the said piece or parcel of land to said John Phelps and his heirs and said David Campbell for himself and his heirs doth covenant with said John Phelps and his heirs that the said Campbell and his heirs said piece or parcel of land unto the said John Phelps and his heirs from him said Campbell and his heirs and all persons claiming under them will warrant and defend but from no other person.  Witness my hand and seal the date first above written.

At a court held for Washington County the 26th day of October 1835.

This Indenture of bargain and sale between David Campbell of the one part and John Phelps of the other part was acknowledged in court by the said Campbell as his act and deed and ordered to be recorded.

[It isn’t clear whether this is the same 25 acre parcel of land that was deeded to John Phelps in 1830 by David Campbell as attorney for Henry and Boggs.  It is in the same area but why would this record be needed since a deed was already on record?  Maybe it’s for a different piece of land adjoining the earlier parcel.]
