Russell County Courthouse, Lebanon, Virginia

This indenture made this fifteenth day of July in the year of our Lord one thousand eight hundred and thirty seven between Edward & Andrew S. Fulton Executors of John H. Fulton of the County of Washington and State of Virginia of the one part and Samuel Phelps of the County of Russell and state aforesaid of the other part. Witnesseth that the said Edward & Andrew S. Fulton Exectr as aforesaid for and in consideration of the sum of ten dollars current money of the united states to them in hand paid, the receipt whereof is hereby acknowledged, do grant bargain and sell unto the said Samuel Phelps a certain tract or parcel of land lying and being in the County of Russell aforesaid, in the North side of Clinch Mountain and on the Crane fork of Mockesin Creek Containing five and three fourths acres, and bound thus: Beginning at a poplar in a branch corner to said Phelps, on a line of the land of Joseph Chapman thence with said line N49W34 poles to a Red oak and white oak, corner to said Chapman. Thence leaving his line North 20 poles to two post oaks, and an Ironwood on the top of a ridge, by a path; S83°E32 poles to two white oaks & dogwood N63E six poles to a walnut and cucumber, corner to said Phelps, and with a line of the same S19W41 poles to the beginning, being part of a tract of 57000 acres Granted by the Commonwealth of Virginia to Hugh McClung with all its appurtenances, to have and to hold, the said tract or parcel of land with all its appurtenances unto the said Samuel Phelps and his heirs forever. And the said Edward and Andrew S. Fulton as Exers aforesaid for themselves and their heirs do covenant with the said Samuel Phelps and his heirs, that they the said Edward and Andrew S. Fulton Exers &c and their heirs the said tract or parcel of land with all its appurtenances unto the said Samuel Phelps and his heirs against the claims of all persons whomsoever shall warrant and will forever defend. In witness whereof the said Edward and Andrew S. Fulton have hereunto subscribed their names, and affixed their seals the day and year first above written.

Virginia, Wythe County to wit:

We Robert Crockett and Fontain Watson Justices of the Peace in the County of Wythe & state of Virginia do hereby Certify that Andrew S. Fulton a party to a certain deed bearing date on the 15th day of July 1837, and hereunto annexed personally appeared before us in our County aforesaid, and acknowledged the same to be his act and deed, and desired us to certify the said acknowledgement to the Clerk of the County Court of Russell in order that the said deed may be recorded. Given under our hands and seals this 19th day of July 1837.

This indenture of bargain and sale from Edward Fulton and Andrew S. Fulton executors of John H. Fulton to Samuel Phelps, certified to have been acknowledged, before two Justices of the Peace by the said Andrew S. Fulton was produced to me in the Clerk's office of Russell County on the 8th day of August 1837 acknowledged by the said Edward Fulton to be his act and deed and admitted to Record. James P.
