Russell County Courthouse, Lebanon, Virginia
This indenture made this 5th day of December in the year of our Lord 1837, between John Phelps of the County of Washington & State of Virginia of the one part and John Kestner of the County of Russell & State aforesaid of the other part. Witnesseth, that the said John Phelps for and in consideration of one hundred & fifty Dollars lawfull money of the United States to him in hand paid by the said John Kestner the Receipt whereof is hereby acknowledged hath bargained & sold & by these presents doth grand bargain & sell unto the said John Kestner his heirs & assigns one certain tract or parcel of land lying and being in the said County of Russell on the head of the Crane fork of Mocasin Creek and on the North side of Clinch Mountain & is the same tract Samuel Phelps conveyed to the said John Phelps by deed bearing date the 2nd day of April 1822 & of Record in the Clerk's office in Russell County, and which said tract of land by a survey lately made is found contain only twenty acres and is bounded as follows, to wit. Beginning at two Buckeyes & a walnut & running N44°W35 poles to a cucumber Symor & Sugartree by a branch N75W6 poles to two sugartrees a corner to a conditional line made with Samuel Phelps thence with said line N22E56 poles crossing a hollow to a double sugartree on the north side of a Ridge on a line of the original survey, thence with said line East 54 poles to a sugartree ash & Mulberry the beginning corner to the original survey thence S4W82 poles to the beginning, with its appurtenances to have and to hold the said tract of Twenty acres be the same more or less, with all its appurtenances unto the said John Kestner and his heirs forever. And the said John Phelps for himself & his heirs doth covenant with said John Kestner & his heirs that he the said John Phelps the said tract or parcel of land with all its appurtenances unto the said John Kestner and his heirs against the claim or claims of all persons whomsoever shall warrant and will forever defend. In witness whereof the said John Phelps hath hereunto subscribed his name and offered his seal on the day & year first herein written.

This indenture of bargain and sale from John Phelps to John Kestner was acknowledged before me in the Clerks' office of Russell County on the 3rd day of April 1838 and admitted to record.
