Martin Phelps buys fifty acres from William Gilmore

This Indenture made this third day of September in the year of our Lord one thousand eight hundred and forty one Between William Gilmore of the County of Russell and State of Virginia of the one part and Martin Phelps of the County of Washington and state aforesaid of the other part.  Witnesseth, that the said Wm. Gilmore for and in consideration of the sum of fifteen dollars to him in hand paid the receipt whereof is hereby acknowledged doth grant bargain and sell unto the said Martin Phelps a certain tract or parcel of land lying and being in Mockason Gap containing by estimation Fifty acres be the same more or less. Beginning at a locust on or near a line of said Phelps’ old tract on the top of what is called the sink hole ridge and running thence in an easterly direction along the main top of said ridge to the cliff of the big mountain then with said cliff northerly to a line of Abram Gobble’s land thence with the line of said Gobble in a westerly direction to a line of John Phelps purchased of said Gilmore thence with said John Phelps line to a white oak corner to Martin Phelps’ old tract then with a line of the same in a southerly direction to the beginning with all its appurtenances unto the said Martin Phelps and his heirs.  To have and to hold the same and the said Wm. Gilmore and his heirs doth covenant with said Martin Phelps and his heirs that he the said Wm. Gilmore and his heirs said piece or parcel of land unto said Martin Phelps and his heirs from him said Wm. Gilmore and his heirs and all persons claiming under them will warrant and shall forever defend.  Witness my hand and seal the date first above written.

Russell County to wit:

We James Browning and Samuel Gibson Justices of the peace in the County aforesaid in the state of Virginia do hereby certify that William Gilmore party to a certain deed bearing date on the third day of September 1841 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desires us to certify the said acknowledgments to the clerk of the County Court of Washington in order that the said deed may be recorded.  Given under our hands and seals this third day of September 1841.

At a court held for Washington County the 28th day of March 1842.

This Indenture of bargain & sale between William Gilmore of the one part and Martin Phelps of the other part was exhibited in Court and appearing to be duly acknowledged before two justices ordered to be recorded.
