Transfer of property from Nelson T. Branch to Joseph H. Covey

As trust against debts

This Deed made the 2nd day of February in the year 1870 between Nelson T. Branch of the first part and Joseph H. Covey of the second part, all of the County of Pulaski and state of Virginia:  Witnesseth, That the said Nelson T. Branch doth grant unto the said Joseph H. Covey the following property to wit: One Bay Mare, One Gray Mare, One two horse Waggon, one set Harnesses, Nine head of sheep, one sow and nine pigs, two cane mills and one calf in trust to indemnify and save harmless David B. Bill as this security of the said Nelson T. Branch in five several forthcoming bonds, this day executed by the said Branch with the said Bill as his security.

One of which forthcoming bonds is executed and payable to John F. Meredith; another to John F. Meredith as adm for John N. Meredith deceased; another to John F. Meredith as adm for John N. Meredith deceased; another to Archer A Phlegar as adm of John Little dec’d and another to Gordon Dobbins; And it shall be the duty of the said trustee, and full power and authority is hereby conferred upon him so to do, wherein executions shall issue upon judgments which may be obtained upon the said forthcoming bonds or any or either of them.  So proceed to sell, in the manner prescribed by law, the property hereby granted, or such part and so much thereof of as may be necessary for that purpose and to apply the money arising from such sale, after satisfying the costs and expenses attendant on the execution of this trust, to the Payment and satisfaction of the said executions in such manner as shall protect the said David B. Bill and prevent the necessity of raising the money to satisfy said executions or either of them, or any part of either, from being imposed upon him.

The object and intention of this deed being to provide a fund, for the payment of the said debts without burdening the said security with their payment in the first instance.  Witness the following signatures and seals

Virginia: in the Clerks office of the County Court of Pulaski County the 19th day of February 1870.

The above deed from Nelson T. Branch to Joseph H. Covey trustee, bearing date the 2nd day of February 1870 was presented in said office and acknowledged by Nelson T. Branch and Joseph H. Covey to be their act and deed and being duly stamped with fifty cents US Revenue Stamps properly cancelled was admitted to record.
