L.P. Summers vs Nelson T. Branch
This cause came on this day, to be heard upon the plaintiff’s bill and exhibits and it appearing to the court, that the defendant has been duly served with a process, and fails to demur, plead or answer, and being argued by counsel, upon consideration whereof the court doth adjudge order and decree, that said bill, as to the defendant, be taken for confessed, and it appearing from the allegations of the plaintiff’s bill, that, two judgments only exist as liens on the lands of the defendant, which judgments are fully set out in the plaintiff’s bill, and that the lands of the defendant will rent for a sum sufficient in five years, to pay the liens thereon, and the costs of this suit, upon consideration whereof, the court doth order, adjudge and decree that, unless the defendant Nelson T. Branch, or some one for him, shall pay the judgment asserted in this cause, with its interest, and the cost of this suit within thirty days from this date, that then, John C. Summers, who is hereby appointed a Commissioner for that purpose shall rent the lands of the defendant, described in the plaintiff’s bill, at the front door of the County Court House of Washington county Virginia at public outcry to the highest bidder, for a term of years sufficient to pay the judgment set out in this cause, with all the costs of this cause, not exceeding five [years?], upon the following terms: cash in hand sufficient to pay the costs of this suit, and said renting, the balance upon an annual credit of one, two, three, four and five years and for which deferred rent, the Commissioner shall require of the lessor his bonds, with good personal security, payable annually but said Commissioner before proceeding to execute this decree, shall execute bond before the Clerk of this Court the sum of $50.00 and shall advertise the time, place and terms of said renting in the Abingdon Virginian for four weeks, and said Commissioner shall report his actions as this cause is continued.
